ESTATE ADMINISTRATION

Estate administration is the process of collecting and managing the estate, paying debts and taxes, and distributing the remaining property. Most often, a decedent’s will names an Executor who will carry out the decedent’s wishes in accordance with the terms of the will. Estate administration can be complicated, and the estate will likely benefit from legal representation.

The goal is often to minimize or eliminate the amount of property that goes through the Probate Court. It often makes sense to deliver an inter-vivos gift, use a living trust, or designate beneficiaries on accounts to pass assets to beneficiaries outside of the Probate Court.
